It is only when courts are apprised of gross violation of fundamental rights by group or class action or when basic human rights are violated or when there are complaints of such acts as shock the judicial conscience , that the courts , especially this court , should leave aside procedural shackles and hear such petitions and extend its jurisdiction under all available provisions for remedying the hardships and miseries of the needy , the underdog and the neglected . केवल तभी जब किसी समूह या वर्ग की कार्रवाई के द्वारा न्यायालय की जानकारी में मूल अधिकारों के घोर उल्लंघन को लाया जाता है या जब आधारभूत मानवाधिकारों का उल्लंघन होता है या जब ऐसे कृत्यों की शिकायतें आएं जिनसे न्यायिक अंत : करण को चोट पहुंचे , तब न्यायालयों , विशेषकर इस न्यायालय को प्रक्रियात्मक बंधनों को एक तरफ रखकर ऐसी याचिकाओं की सुनवाई करनी चाहिए और जरूरतमंद , दलित तथा उपेक्षित लोगों के कष्ट , दु : ख और दुर्गति का उपचार करने के लिए सभी उपलब्ध उपबंधों के अधीन अपनी अधिकारिता का विस्तार करना
